THIS SWEEPSTAKES IS OFFERED IN THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (D.C.). THIS SWEEPSTAKES IS VOID ELSEWHERE AND WHEREVER PROHIBITED BY LAW. THIS SWEEPSTAKES SHALL BE CONSTRUED AND EVALUATED IN ACCORDANCE WITH ALL APPLICABLE LAWS AND REGULATIONS. THIS SWEEPSTAKES IS OPEN SOLELY TO PERSONS WHO ARE LEGAL RESIDENTS OF, AND CURRENTLY RESIDING IN, ONE OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA, AND WHO ARE AT LEAST 18 YEARS OF AGE (19 YEARS OF AGE IF A RESIDENT OF THE STATES OF ALABAMA OR NEBRASKA) WITH AN ACTIVE AND VALID E-MAIL ADDRESS AT TIME OF ENTRY.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING A PRIZE. INTERNET ACCESS IS REQUIRED TO ENTER.
PopCap Games, Inc. (“Sponsor”) is offering this Sweepstakes (“Sweepstakes”). David Kessler & Associates, Inc. (“Administrator”) is administering the operation of, and prize fulfillment under, this Sweepstakes. Sponsor and Administrator shall be referred to collectively as the “Sweepstakes Entities”.

  1. This Sweepstakes is open solely to legal residents of the 50 United States and the District of Columbia (“D.C.”) who (a) are presently located and living in one of the eligible jurisdictions listed above, (b) are 18 years of age or older (19 or older if a resident of Alabama or Nebraska) as of the time of entry, and (c) have an active and valid e-mail address as of time of entry. The Sweepstakes is void outside the 50 United States and D.C. and wherever prohibited by law. Employees of Sponsor and Administrator, their respective parent companies, affiliates, subsidiaries, agents, marketing and advertising agencies, and certain other companies with which Sponsor does business such as, but not limited to, Sprint, Samsung, Worldwinner/GSN, King.com, Wild Tangent and Wetpaint, and members of the immediate families (defined for these purposes as including parents, spouses, children, siblings, grandparents, grandchildren, aunts and uncles, and each of their respective spouses, regardless of whether living in the same household) or households (regardless of whether related) of any of the above persons, are NOT eligible to participate in this Sweepstakes or to receive any prize hereunder. Proof of eligibility may be required.
  2. Sweepstakes begins at 12:00:01 pm Pacific Time (“PT”) on 10/27/08 and ends at 11:59:59 pm PT on 1/8/09 (the “Sweepstakes Period”). Limit of one (1) entry per person/household (as determined by email address account holder and/or household address) per day. Proof of entry submission will not be deemed proof of receipt of such entry by Sponsor or Administrator.
  3. Each participant must complete an on-line entry form at http://www.popcappromos.com/sprintspin with all required information and must submit such completed entry form, in accordance with the instructions on such Web site and herein, for receipt by Administrator within the Sweepstakes Period. Any Sweepstakes participant who desires to be contacted for future promotional purposes may check the opt-in box on the entry form. All Sweepstakes entry forms and other related materials submitted shall become the exclusive property of Sponsor and shall be neither acknowledged nor returned except as provided herein.
  4. In the event of a dispute as to who is entitled to receive a Sweepstakes entry, such entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided that such person otherwise meets each of the eligibility requirements of these Rules. "Authorized account holder" means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Any potential prize winner hereunder may be requested to provide proof that he/she is the authorized account holder. Sweepstakes Entities hereby specifically reserve the right to invalidate any and all Sweepstakes entries that are made through any robotic, automatic, mechanical, programmed or similar entry duplication method, or through fraud, and to disqualify the individuals using such a method from participating in this Sweepstakes or receiving any prize hereunder. By entering, each participant in this Sweepstakes hereby agrees to irrevocably release, indemnify and hold harmless the Sweepstakes Entities, each of their respective advertising, marketing and promotion agencies, and the officers, directors, employees, designees and agents of each of the foregoing (collectively, the “Released Parties”), from and against any and all claims, actions, causes of action, demands, judgments, liability, injuries, damages, losses, costs and expenses (collectively, “Claims”) arising out of or relating to, directly or indirectly, in whole or in part, any of the following: (a) participation of entrant in this Sweepstakes or in any Sweepstakes- or prize-related activities (if applicable); (b) the acceptance, possession or use/misuse of any prize (if applicable) by entrant ; (c) electronic transmissions or Sweepstakes entries that are lost, late, stolen, incomplete, illegible, indecipherable, inaccurate, damaged, garbled, destroyed, misdirected or not received by Sponsor or Administrator for any reason; (d) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of any Sweepstakes entries, or the destruction of or unauthorized access to, or alteration of, any Sweepstakes entries; (e) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that may jeopardize the administration, security, fairness, integrity, safety or proper conduct of this Sweepstakes; (f) the submission of any Sweepstakes entries in a manner that is not expressly allowed under these Rules; (g) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in this Sweepstakes; (h) any typographical or other error in any printing or advertising related to this Sweepstakes, in the administration or execution of this Sweepstakes, or in the announcement of prizes/prize winners; or (i) cheating or fraud by any participant. SOME JURISDICTIONS, MAY NOT ALLOW SOME OF THE LIMITATIONS OR EXCLUSIONS OF LIABILITY LISTED ABOVE, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR PROHIBITIONS REGARDING SUCH LIMITATIONS AND EXCLUSIONS. All incomplete or otherwise non-conforming Sweepstakes entries will be disqualified from the Sweepstakes and ineligible to receive any prize hereunder. If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause(s) beyond the control of Sponsor that may corrupt or affect the security, administration, fairness, integrity, safety or proper conduct of this Sweepstakes, or if this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor hereby specifically reserves the right, exercisable at any time thereafter by Sponsor in its sole discretion or by Administrator, on behalf of Sponsor, to terminate, suspend or modify this Sweepstakes. If this Sweepstakes is terminated before the scheduled conclusion date of the Sweepstakes Period as stated herein, then Administrator (or its designee) will select the potential winners of the prizes described below, by means of a random drawing from among all eligible, non-suspect Sweepstakes entries received by Administrator prior to the date and time of such termination. Sweepstakes Entities hereby reserve the right, exercisable at any time in their sole discretion (and without limitation of any and all other legal and/or equitable rights and remedies that may be available), to disqualify from this Sweepstakes and to prosecute any individual(s) who is (are) found to be tampering with or attempting to tamper with the Sweepstakes entry process or any other part of this Sweepstakes. CAUTION: ANY ATTEMPT BY ANY PERSON(S) DELIBERATELY TO DAMAGE ANY WEB SITE OR OTHERWISE TO CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR HEREBY SPECIFICALLY RESERVES THE RIGHT TO DISQUALIFY (FROM THIS SWEEPSTAKES), PROSECUTE AND SEEK DAMAGES FROM AND AGAINST ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
  5. One (1) Grand Prize will be awarded, consisting of a Sony - VAIO Laptop with Intel® Core™2 Duo Processor P8400 Laptop (Model: VGN-FW139E/H) (including a library of PopCap games). ARV: $1,850. Four (4) First Prizes will be awarded, each consisting of a PopCap Platinum Pack ARV: $350 per prize. Twenty (20) Second Prizes will be awarded, each consisting of a Bejeweled Game Pack (includes 3 games), ARV: $50 per prize. Two hundred (200) Third Prizes will be awarded, each consisting of a Bejeweled Twist Game download. ARV: $19.95 per prize. One hundred (100) Fourth Prizes will be awarded, each consisting of a Bejeweled Twist limited edition jewel paperweight. ARV: $7.95 per prize. Bejeweled Twist requires a minimum of a 100% Pentium II 700 MHz PC compatible computer; 256 MB RAM; Windows 98, ME, 2000, XP or Vista OS; DirectX7 or better and DirectX certified sound card; and a 16-bit or 32-bit display. Total ARV of all prizes in this Sweepstakes is $9,035.
  6. Instant Winner Prize Selection: There will be three hundred twenty five (325) random, computer-generated winning game times/dates during the Sweepstakes Period. If your online entry is the first one that reaches our server at the predetermined winning time/date or within one minute after the predetermined winning time/date, you are the potential winner of the designated prize for that time/date. If you get a message that you are an instant winner, please follow the onscreen instructions to claim your prize. If no one reaches the server during that time period, and the Prize is a Grand, First or Second Prize, then that prize will be deemed “unclaimed”, and will be awarded in a random Second Chance drawing (see details in Rule 8, below). If any Grand, First or Second Prize is unclaimed at the end of the Sweepstakes Period, the corresponding potential prize instant winner will be disqualified and will forfeit the prize, and the prize will be awarded in the Second Chance random drawing. Unclaimed Third and Fourth Prizes will not be awarded. The computer clock of the Administrator’s Webmaster is the official timekeeping device of the Sweepstakes.
  7. Odds of winning a prize depend on the number of eligible entries received and the timing of such entries. Prizes may not be transferred, assigned, redeemed for cash or substituted, except that Sponsor may substitute a prize (or any component thereof) with a different prize (or prize component) of equal or greater value, if the advertised prize (or any component thereof) becomes unavailable. All applicable income taxes in connection with the receipt, possession or use of any prize awarded in this Sweepstakes are the sole and full responsibility of the prize winner. Limit of one (1) prize per household. All other details of the prizes that are not set forth specifically above shall be determined at Sponsor’s sole discretion. If for any reason a potential prize winner cannot accept his/her prize in accordance with each of the applicable provisions of these Rules, then (a) such potential prize recipient will forfeit all rights to receive and use the prize (and all components thereof); and (b) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential prize recipient.
  8. If any Grand, First or Second Prize is unclaimed at the end of the Sweepstakes Period, then on approximately 1/15/09, as the means for awarding such prizes , Administrator (or its designee) will conduct a random drawing from among all eligible Sweepstakes entries received throughout the entire Sweepstakes Period. Administrator is independent of Sponsor, and each of Administrator’s decisions in all matters relating to eligibility, prize fulfillment and this Sweepstakes shall be final, binding and non-appealable in all respects. The potential prize winners must comply fully with each provision of these Official Rules in order to remain eligible to receive their respective prizes. Sweepstakes Entities will attempt to notify each potential prize winner in the Second Chance drawing (if any) by means of regular U.S. Mail, telephone, e-mail or other appropriate means within approximately ten (10) days after the date of the above-described drawing. If any potential prize winner (instant winner or Second Chance drawing winner) is found to be ineligible for any reason; (b) any potential prize winner (instant winner or Second Chance drawing winner)fails to comply with each provision of these Official Rules; or (c) the notification to any potential prize winner (instant winner or Second Chance drawing winner)is returned as undeliverable, then (i) such potential prize winner will forfeit all rights to receive and use the prize (and all components thereof), and (ii) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential prize. The potential Grand Prize winner and First Prize winners shall be required to complete, sign and return an Affidavit of Eligibility (applies to the potential Grand Prize winner and First Prize winners only), Liability Release, and (where legal) a Publicity Release, within fourteen (14) days after the date of initial notification; otherwise, (A) such potential Grand Prize and First Prize winners will forfeit all rights to receive and use the Grand Prize and First Prize (and all components thereof); (B) Sweepstakes Entities shall be relieved of any and all further obligations or liability to such potential Grand Prize and First Prize winners; and (c) Sweepstakes Entities shall have the right (but not the obligation) to select an alternate potential Grand Prize and First Prize winner by means of a subsequent random drawing to be conducted by Administrator (or its designee) from among all other remaining eligible Sweepstakes entries received.
  9. Subject solely to Sponsor’s privacy policy at http://www.popcap.com/terms.php#privacy, any potential prize winner (except a resident of TN) hereby irrevocably agrees that upon his acceptance, receipt or use of the prize, the Sweepstakes Entities may use his/her name, city and state of residence, likeness (photographic or simulated) and/or voice for any and all advertising, marketing, promotion, public relations or other business operations or trade purposes whatsoever, in any and all media (whether now known or hereafter devised) throughout the world, in perpetuity, without any restriction(s), further notice, approval, or further payment of compensation of any kind or amount, except solely to the extent prohibited by applicable law. By participating in this Sweepstakes, each entrant hereby irrevocably agrees to be bound by (i) each provision of these Official Rules and (ii) each decision of the Administrator, which shall be final, binding and non-appealable in all respects.
  10. For the names of the Grand, First and Second Prize winners (available after 2/6/09), send a self-addressed, stamped #10 size envelope, postmarked by no later than 1/15/09, to PopCap Games “Give It a Spin” Game, P. O. Box 6185, Buffalo Grove, IL 60089-6185.
